Mr.Chairman,SenatorThurmond,membersofthecommittee,mynameisAnitaF.Hill,andIamaprofessoroflawattheof,in1956.Iamtheyoungestof13children.IhadmyearlyeducationinMychildhoodwasoneofalotofhardworkandnotmuchmoney,butitwasoneofsolidfamilyaffection,asrepresentedbymyparents.IwasrearedinareligiousatmosphereintheBaptistfaith,andIhavebeenamemberofthe,since1983.Itisaverywarmpartofmylifeatthepresenttime.

Igraduatedfromtheuniversitywithacademichonorsandproceededtothe,whereIreceivedmyJDdegreein1980.Upongraduationfromlawschool,Ibecameapracticinglawyerwiththe,In1981,IwasintroducedtonowJudgeThomasbyamutualfriend.JudgeThomastoldmethathewasanticipatingapoliticalappointment,andheaskedifIwouldbeinterestedinworkingwithhim.Hewas,infact,appointedasAssistantSecretaryofEducationforCivilRights.Afterhehadtakenthatpost,heaskedifIwouldbecomehisassistant,andIacceptedthatposition.

DuringthisperiodattheDepartmentofEducation,myworkingrelationshipwithJudgeThomaswaspositive.Ihadagooddealofresponsibilityandindependence.Ithoughtherespectedmyworkandthathetrustedmyjudgment.Afterapproximatelythreemonthsofworkingthere,heaskedmetogooutsociallywithhim.

IdeclinedtheinvitationtogooutsociallywithhimandexplainedtohimthatIthoughtitwouldjeopardizewhatatthetimeIconsideredtobeaverygoodworkingrelationship.Ihadanormalsociallifewithothermenoutsideoftheoffice.Ibelievedthen,asnow,thathavingasocialrelationshipwithapersonwhowassupervisingmyworkwouldbeill-advised.Iwasveryuncomfortablewiththeideaandtoldhimso.

MyworkingrelationshipbecameevenmorestrainedwhenJudgeThomasbegantouseworksituationstodiscusssex.Ontheseoccasions,hewouldcallmeintohisofficeforreportsoneducationissuesandprojects,orhemightsuggestthat,becauseofthetimepressuresofhisschedule,wegotolunchtoagovernmentcafeteria.Afterabriefdiscussionofwork,hewouldturntheconversationtoadiscussionofsexualmatters.

BecauseIwasextremelyuncomfortabletalkingaboutsexwithhimatallandparticularlyinsuchagraphicway,ItoldhimthatIdidnotwanttotalkaboutthesesubjects.Iwouldalsotrytochangethesubjecttoeducationmattersortononsexualpersonalmatterssuchashisbackgroundorhisbeliefs.Myeffortstochangethesubjectwererarelysuccessful.

DuringthelatterpartofmytimeattheDepartmentofEducation,thesocialpressuresandanyconversationofhisoffensivebehaviorended.Ibeganbothtobelieveandhopethatourworkingrelationshipcouldbeaproper,cordial,andprofessionalone.

FormyfirstmonthsattheEEOC,whereIcontinuedtobeanassistanttoJudgeThomas,therewerenosexualconversationsorovertures.However,duringthefallandwinterof1982,thesebeganagain.ThecommentswererandomandrangedfrompressingmeaboutwhyIdidn''''tgooutwithhimtoremarksaboutmypersonalappearance.IrememberhissayingthatsomedayIwouldhavetotellhimtherealreasonthatIwouldn''''tgooutwithhim.

OneoftheoddestepisodesIrememberwasanoccasioninwhichThomaswasdrinkingaCokeinhisoffice.Hegotupfromthetableatwhichwewereworking,wentovertohisdesktogettheCoke,lookedatthecanandasked,"WhohaspubichaironmyCoke?"Onotheroccasions,hereferredtothesizeofhisownpenisasbeinglargerthannormal,andhealsospokeonsomeoccasionsofthepleasureshehadgiventowomenwithoralsex.

InJanuaryof1983,Ibeganlookingforanotherjob.IwashandicappedbecauseIfearedthat,ifhefoundout,hemightmakeitdifficultformetofindotheremploymentandImightbedismissedfromthejobIhad.Anotherfactorthatmademysearchmoredifficultwasthattherewasaperiod--thiswasduringaperiodofahiringfreezeinthegovernment.InFebruaryof1983,IwashospitalizedforfivedaysonanemergencybasisforacutestomachpainwhichIattributedtostressonthejob.

Inthespringof1983,anopportunitytoteachatopenedup.Iparticipatedinaseminar--taughtanafternoonsessionandseminarat.ThedeanoftheuniversitysawmeteachingandinquiredastowhetherIwouldbeinterestedinfurthering--pursuingacareerinteaching,beginningatOralRobertsUniversity.IagreedtotakethejobinlargepartbecauseofmydesiretoescapethepressuresIfeltattheEEOCduetoJudgeThomas.

On,asIrecall,thelastdayofmyemploymentattheEEOCinthesummerof1983,IdidhavedinnerwithClarenceThomas.Wewentdirectlyfromworktoarestaurantneartheoffice.WetalkedabouttheworkIhaddone,bothateducationandattheEEOC.HetoldmethathewaspleasedwithallofitexceptforanarticleandspeechthatIhaddoneforhimwhilewewereattheOfficeforCivilRights.Finally,hemadeacommentthatIwillvividlyremember.HesaidthatifIevertoldanyoneofhisbehaviorthatitwouldruinhiscareer.Thiswasnotanapology,norwasitanexplanation.Thatwashislastremarkaboutthepossibilityofourgoingoutorreferencetohisbehavior.

Ononeoccasionhecalledmeathomeandwehadaninconsequentialconversation.Ononeoccasionhecalledmewithoutreachingme,andIreturnedthecallwithoutreachinghim,andnothingcameofit.Ihaveonatleastthreeoccasions,beenaskedtoactasaconduittohimforothers.

IdidcallinJanuaryandFebruarytonoeffect,andfinallysuggestedtothepersondirectlyinvolved,SusanCahal(ph)thatsheputthematterintoherownhandsandcalldirectly.ShedidsoinMarchof1985.InconnectionwiththatMarchinvitation,Ms.Cahal(ph)wantedconferencematerialsfortheseminarandsomeresearchwasneeded.Iwasaskedtotrytogettheinformationanddidattemptedtodoso.

ItisonlyafteragreatdealofagonizingconsiderationthatIamabletotalkoftheseunpleasantmatterstoanyoneexceptmyclosestfriends.AsI''''vesaidbeforetheselastfewdayshavebeenverytryingandveryhardformeandithasn''''tjustbeenthelastfewdaysthisweek.IthasactuallybeenoveramonthnowthatIhavebeenunderthestrainofthisissue.

AsIsaid,Imayhaveusedpoorjudgment.PerhapsIshouldhavetakenangryorevenmilitantsteps,bothwhenIwasintheagency,orafterIleftit.ButImustconfesstotheworldthatthecoursethatItookseemedthebetteraswellastheeasierapproach.Ideclinedanycommenttonewspapers,butlaterwhenSenatestaffaskedmeaboutthesemattersIfeltIhadadutytoreport.IhavenopersonalvendettaagainstClarenceThomas.Iseekonlytoprovidethecommitteewithinformationwhichitmayregardasrelevant.
