三、要高度重视和妥善处理好集体劳动争议及其引发的集体上访和停工停产事件。这类事件对首都的稳定和各项改革的顺利实施危害极大。各单位领导要给予高度重视,把维护首都稳定和职工队伍稳定工作做为一项重要工作来抓。劳动行政部门要明确一位主要领导亲自抓维护稳定的工作,在思想上和组织上做好充分准备,提前制定好处理集体劳动争议及由此引发的集体上访和停工、停产事件的预案。企业主管部门要对所属企业劳动关系现状逐一进行调查摸底、确定重点,帮助其解决影响职工队伍稳定的突出问题。对企业在改革中出现的问题,特别是发生严重损害职工合法权益的问题时,劳动行政部门和企业主管部门要进行必要的干预,妥善处理、防止事态的扩大。对已发生职工集体上访和停工、停产事件要组织得力干部赶赴现场,进行处理。尽量引导双方,尤其是职工一方向劳动争议仲裁部门申请仲裁。各级仲裁委员会在不违背《条例》基本精神的前提下,可酌情灵活掌握,尽快妥善处理。
四、根据劳动部的要求,各区、县劳动局和总公司内部要建立集体劳动争议和停工、停产事件的信息报告制度。发生事件的企业劳动部门应负责在事件发生的当天将事件发生的起因、职工人数和企业的意见报告主管局、总公司及企业所在区、县劳动局。对发生100人以上的职工集体上访和停工、停产事件,应直接报告市劳动局。区、县劳动局和企业主管局、总公司获悉发生事件的信息后,应及时将发生事件的单位、人数、时间、地点、原因、经过和社会反映等情况向市劳动局报告。市劳动局由劳动争议仲裁处负责此类信息的汇总和报告工作。各区、县劳动局应确定一个职能科室负责报告,局、总公司劳动处也应指定一名干部负责此项工作。对于隐瞒情况不报或玩忽职守、拖报、漏报的,有关领导要给予批评,造成严重后果的,要追究有关人员的责任。
